Participation Terms

1. Eligibility

Participation is open to natural persons aged 16 or older.
Persons under 18 require the consent of a legal guardian.
Participation is free and requires registration at bergkoenig.app.
Only one account per person is allowed. Multiple accounts will result in exclusion.
Employees of Bergkönig and their relatives are excluded from raffles.

Bergkönig is a peak-collecting game for the Alpine region.
Points are earned by ascending peaks.
Point calculation is based on: elevation gain (EG/100), distance (km × 1), peak bonus (+10), and multipliers (Pioneer ×3, First visit ×2, Repeat ×0.2).
Additional bonuses: Early bird (tour before 07:00, +15 pts), Combo (2+ peaks/day), Streak (weekly activity).
GPS data is used exclusively for summit detection and is not stored.
Manipulation (faked GPS data, bots, multiple accounts) leads to immediate exclusion.

Each ascended peak = 1 raffle ticket.
Pioneer ascent (first of the season) = 3 raffle tickets.
King of a peak = 5 raffle tickets per crown.
Active weekly streak = 1 raffle ticket per week.
Peak of the day ascended = 3 raffle tickets.
Raffles will only take place once 500 participants are registered.
Raffles are held at the end of the season (December 31) via random number generator.
There is no legal entitlement to the conduct of raffles.
Cash payout of prizes is excluded.

All prizes are provided by sponsors and partners.
Bergkönig assumes no warranty or liability for the prizes.
Complaints about prizes should be directed to the respective sponsor/manufacturer.
The type and scope of prizes may vary and will be announced before the raffle.

Winners will be notified by email to the address provided during registration.
Winners have 14 days to accept the prize. After the deadline, a replacement winner will be drawn.
The winner's username will only be published in the app with explicit consent.

For participation, only email address and username are stored.
GPS tracks are processed for summit detection but not stored. Only derived results (peak, timestamp, elevation gain) are stored.
Personal data is not shared with sponsors or third parties.
In case of a win, the email address is used exclusively for contact and prize delivery.

Bergkönig is a game — not a mountain guide and not a safety tool.

Participation in Bergkönig is at your own risk.
Bergkönig assumes no liability for accidents, injuries, property damage, or other damages arising in connection with mountain sports.
Participants are personally responsible for their safety in the mountains.
The avalanche situation must be checked independently at lawinen.report or with local authorities.
Bergkönig does not replace professional route planning, mountain guides, or Alpine clubs.
The safety system in the app (avalanche danger level) serves only as an indication and is not binding.
Bergkönig is not liable for the accuracy, completeness, or timeliness of data displayed in the app (peak positions, elevation data, routes, safety information).

Bergkönig reserves the right to exclude participants for violations of these terms at any time and without giving reasons.
The following actions in particular lead to exclusion: manipulation of GPS data, use of bots, creation of multiple accounts, insulting other participants.
Upon exclusion, all collected points, raffle tickets, and prize claims are forfeited.

Bergkönig reserves the right to change these Participation Terms, game rules, and the points system at any time.
Significant changes will be announced in the app.
Continued use of the app after a change constitutes acceptance.

Austrian law applies.
Place of jurisdiction is Feldkirch, Austria.
Legal recourse is excluded.
Should individual provisions be invalid, the remaining provisions shall remain unaffected.
